Terms of Service
Welcome to the network of interactive services owned, operated, or provided by Talk 4 Media. These Terms of Use (“Terms”) govern your use of any Talk 4 Media Local web site or service (collectively, the “Services” or “Talk 4 Media) that includes an authorized link to these Terms.

This site or application is owned or managed by Talk 4 Media and is part of Talk 4 Media family of companies, which includes other quality entertainment brands such as Internet radio stations, magazines, internet television shows, as well as other services including but not limited to: W4CY.COM, W4CS.COM, W4VET.COM, W4WN.COM,W4HC, PetHealthCafe.com, W4TSR.com, Intertainment Television, Intertainment IMAG, 4C Marketing Group, Florida Creative Living Magazine, DrMotivator and Your Web Surgeon.

Talk 4 Media is intended for general information purposes only. It is not designed to provide listeners with specific and personal, medical, financial, legal, counseling, professional service or any advice. The programs are not meant to diagnose, treat, cure or prevent any disease. Individuals with health problems should always consult their health care provider for professional medical advice, medications or treatments. Talk 4 Media also does not promote anyone’s individual practice, programs, agendas, particular treatments, healthcare programs, providers, hospitals or medical centers.

The views expressed by show hosts or their guests are their own and shall not be construed in any way as advice from Talk 4 Media. We make no recommendations or endorsements for radio show programs, services, or products mentioned on-air or on our web. Personal prospectives expressed by the producers, writers or editors will always be presented as such. We encourage you to seek professional advice or care for any problem which you may have.

No liability, explicit or implied, shall be extended to Talk 4 Media or the show hosts whose words and/or opinions appear from or on this Web site.
Changes

We may occasionally change these Terms, so we encourage you to review the Terms periodically. The most current version of the Terms (along with their effective date) will be linked from each of the Services. If you continue to use the Services after we change the Terms, you accept all changes.

PLEASE READ THE TERMS OF THIS AGREEMENT CAREFULLY BEFORE ACCESSING OR USING THE SITE OR THE SERVICE. BY ACCESSING OR USING THE SITE OR THE SERVICE, YOU AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT. PLEASE DO NOT USE THE SITE OR THE SERVICE IF YOU DO NOT AGREE WITH THIS AGREEMENT. BY USING ANY OF THE SERVICES, YOU ACCEPT THESE TERMS.

Internet Radio: We provide only the Internet Radio Service. You must purchase your computer, laptop, alternate Web Device, modem or router, and Internet service and/or any other appropriate hardware and/or software, from appropriate sellers, resellers, manufacturers or service providers. We are not responsible for and do not warrant any Web Devices in any way whatsoever and are not responsible for the advertising, statements, practices, promises, services or warranties of such sellers, manufacturers or installers. If you have any complaints about your Web Device, you should direct them to the applicable seller, reseller, manufacturer, or service provider.

Internet Radio: You may not rebroadcast the Internet Radio Service in any way. You may play the Internet Radio Service through speakers or headphones for your personal listening pleasure. You may not make any recordings of, or otherwise duplicate, the content provided by the Internet Radio Service. In addition, you may not re-transmit or otherwise distribute the content provided by the Internet Radio Service in any way, including online streaming such content or making such content available for download. You may not re-skin, re-package, decompile, reverse engineer, or disassemble the Internet Radio Service, or construct a media player or interface that accesses the Internet Radio Service. In addition, your use of any products or services that access the Internet Radio Service and which are provided by third parties not authorized by us constitutes a violation of this Agreement, even if you did not create such product or services and/or do not understand how they were created.

Termination/access restriction
Talk 4 Media reserves the right, in its sole discretion, to terminate your access to the Sites and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Florida and you hereby consent to the exclusive jurisdiction and venue of courts in Florida in all disputes arising out of or relating to the use of the Sites. Use of the Sites is unauthorized in any jurisdiction that does not give effect to all provisions of these

Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Talk 4 Media as a result of this agreement of use of the Sites. Talk 4 Media’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Talk 4 Media’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Sites or information provided and to or gathered by Talk 4 Media with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Talk 4 Media with respect to the Site and it supersedes all prior or contemporaneous communication and proposals, whether electronic, oral or written, between the user and Talk 4 Media with respect to the Sites. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Mobile devices

If permitted or available through the applicable Talk 4 Media/Service to (a) upload content to this Talk 4 Media Site via your mobile device and/or tablet, (b) receive and reply to messages, or to access or make posts using text messaging, (c) browse this Talk 4 Media Site from your mobile device and/or (d) to access certain features through a mobile application you have downloaded and installed on your mobile device (collectively the “Mobile Services”), you must have a mobile communications subscription (or have the consent of the applicable subscriber) with a participating carrier or otherwise have access to a mobile communications network for which Talk 4 Media makes Talk 4 Media available as well as any carrier services necessary to download content, and pay any service fees associated with any such access (including text messaging charges for each text message you send and receive on your mobile device). In addition, you must provide all equipment and software necessary to connect to Talk 4 Media and it’s services, including, but not limited to, if this Talk 4 Media contains a mobile element, a mobile hand set or other mobile access device that is in working order and suitable for use in connection with Talk 4 Media services and to use any part of that Service. You are responsible for ensuring that your equipment and/or software does not disturb or interfere with Talk 4 Media’s or this Talk 4 Media Site’s operations or Talk 4 Media Services. Any equipment or software causing interference will be immediately disconnected from Talk 4 Media services and Talk 4 Media will have the right to immediately terminate this Agreement. If any upgrade in or to Talk 4 Media services requires changes in your equipment or software (including the operating system for your Device), you must effect these changes at your own expense. Unless explicitly stated otherwise, any new or additional features that augment or enhance the current Talk 4 Media service, including the release of new products and services, will be subject to the terms and conditions of this Agreement. You agree to follow and comply with any applicable laws in your use of Talk 4 Media services.

Accounts, Security, Passwords
If a particular Talk 4 Media Site or Talk 4 Media Internet Service requires you to open an account, you must complete the specified registration process by providing us with current, complete, and accurate information as requested by the applicable online registration form. It is your responsibility to maintain the currency, completeness, and accuracy of your registration data and any loss caused by your failure to do so is your responsibility. After you have fully completed the registration form, you may be asked to choose a password and a user name. It is entirely your responsibility to maintain the confidentiality of your password and account. Additionally, you are entirely responsible for any and all activities that occur under your account. You agree to notify Talk 4 Media immediately of any unauthorized use of your account. Talk 4 Media is not liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. You may cancel your account by delivering notice in the manner provided in the Additional Terms governing the particular Talk 4 Media Service.

Privacy
Our privacy policy describes our practices concerning data that you provide or that we may collect about you through the Services (content), and you consent to our use of data in compliance with the Privacy Policy Our Privacy Policy governs the treatment by us of both anonymous and personally identifiable information that we collect when you use the Site or the Service and when you provide information to us in any medium for the Service, or any other services we may offer. Scope of Privacy Policy
This Privacy Policy applies to information, including contact information, collected about you by an Talk 4 Media web Site. Please see our PRIVACY POLICY for more information. Sweepstakes, contests, and promotions on the Services may also have additional rules and eligibility requirements, such as certain age or geographic area restrictions, and you are responsible for complying with these rules and requirements. INTELLECTUAL PROPERTY; LICENSE
The content, information, data, designs, code, and materials associated with the Services (“Content”) are protected by intellectual property and other laws. You must comply with all such laws and applicable copyright, trademark, or other legal notices or restrictions.

We may expressly authorize you to redistribute certain Content for personal, non-commercial use. We will identify the Content that you are authorized to redistribute and describe ways you may redistribute it (such as via email, blogs, or embedded players, or by producing Mash-Ups). Copyright is claimed to the entire body of the site, as an entity, and to the HTML, Javascript, Flash, PHP, WordPress code or any other coding embedded, iframed, or otherwise. Talk 4 Media pays for licensing rights to use legal music and any embedded players. The video and audio players of this site are only licensed through this site and use of the players on any other site is not authorized by Talk 4 Media is a direct violation of licensing laws and is strictly prohibited as such as per licensing restrictions. Anyone wishing to have our radio station offered through their site must have their web visitors click a link to this site. Talk 4 Media is not responsible for any content on this site submitted by outside providers or linked in from an outside site. The topics and opinions expressed on any of the shows are solely those of the hosts and their guests and not those of Talk 4 Media, its employees or affiliates. We make no recommendations or endorsements for radio show programs, services, or products mentioned on-air or on our web. Any health related information on any of the shows provides general information only. Content presented on any show, by any host or guest should not be substituted for a doctor’s advice. Acceptable Use
The Services have been designed to present Content in a unique format and appearance. Unless we give you permission, you agree not to access the Services using any interface other than ours. We may deny permission to link to the Services for any reason in our sole discretion, and you must be able to edit or delete promptly links that you create, upon our request.

Talk 4 Media does not claim ownership of the materials you provide to Talk 4 Media (including feedback and suggestions) or post, upload, input or submit to any Talk 4 Media Site or its associated services (collectively “Submissions”). Talk 4 Media does not warrant or guarantee 1) the accuracy, adequacy, quality, currentness, validity, completeness, or suitability of any Information for any purpose; 2) that the Information will not contain adult-oriented material, or material which some individuals may deem objectionable; or 3) that the functions or services performed by Talk 4 Media will be uninterrupted or error-free or that defects in Talk 4 Media will be corrected. Governing Law, Venue, and Jurisdiction
These Terms and all claims arising from or related to your use of the Services will be governed by and construed in accordance with the laws of the State of Florida, except Florida’s conflict of law rules. These Terms will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, if applicable.

Indemnification

This defense and indemnification obligation will survive any termination of this Agreement and your use of the Site.

Programs or other use of the Site violates the intellectual property rights of any third parties, defames any third parties, constitutes impermissible hate speech or otherwise violates any rights of free speech or any other rights of any third parties; and (d) any portion of the content of any podcast or pre-recorded program created or hosted by You or under your authority, including the content that You generate as well as any content contributed in any manner by any guest or caller on any podcast or pre-recorded program created or hosted by you or under your authority. This defense and indemnification obligation will survive any termination of this Agreement and your use of the Site.
